Is it my gym authorized to amend the contract without notice? My gym (Holmes Place) has been taken over by Virgin Active, and I have not received any notification or details of a change of contract. I called to put a freeze on my account, only to be told that the time has changed (now) and has adopted a £ 7 fee is payable if I want to freeze my account in April.
According to my contract, "The Proprieter give not less than one month's written notice of any change in fees and other costs ... unless the member pays his subscription membershp in advance in this case, these changes apply to the date on which the next annual fee payment deadline.
Can they change their fair share of the market like that? I received no letter summary of changes to my contract.
All advice welcome!
If a change of contract like this, there is a grace period of (usually) a few weeks. Basically, because the details of your contract have changed, the original contract is canceled and you can walk away from him if you want. After these few weeks, your new contract, they changed automatically go into effect and you're stuck with it, like it or not.
So yes, they can change as they wish, but you do not have to go with it. It must be buried in the fine print.
Please do not take legal advice on this site (as is given above.) You (or counsel) may review the contract and understand it, anyone who even attempts to answer this question obviously includes nothing.
gyms are allowed to do anything, seems that way.
