Trampoline Tie DownsIs this a direction for manufacturers to take / stow a trampoline in high winds remove the act of defense of God?

I would say that this was not the wind that caused the damage, it was the trampoline.

The question here is "reasonable foreseeability"

It is reasonably foreseeable that the trampoline will probably leave the ground on windy days?

In my opinion, because of how it is built there is a reasonable chance that wind will raise the floor if it is not bound to or taken inside.

Your neighbor has been negligent, I have no doubt she has seen or heard the weather forecast?

Tell him to get a law degree before quoting the law to people she does not know what she means. Unless God was on the trampoline at a time!

See a good lawyer

Then take him to court in the tort of negligence, do not forget to claim your prize.

Lawsuits yes from idiots make instructons necessary to say the obvious: If there is a storm, take it down, this is not a building.

I doubt that the defense of "act of God" exists. The test of negligence is "what happened reasonably foreseeable" that a man "reasonable" would probably say yes, and if the advice given is for the docking, then there is surely a claim?

If you are stupid enough to leave during a storm or high winds, then you get what you deserve ... Man, there must be some sense in this kind of thing ...

Strong winds are not defined as an act of God, hurricanes tornadoes officially classified by the Met Office. Thus, the instructions that cover I think ....
