Cancelling gym membership? We were members of the Holmes Place gym for 5 years. Due to an error of HP son received the free membership, no end date. We have lost copies of the contract or free membership. HP has been taken over by VirginActive. Our son has used the gym with the map and swimming lessons. 1 year after the VA to care less than 2 weeks notice that our son should be a member of children full and pay £ 15h. I phoned the club, talk to service members and to cancel the membership verbally. I asked him if I need to do something else to do the actual cancellation. She said no. We act on his advice, do nothing and cancel the DD
Virgin now demanding a fee of months because we did not give 30 days notice in writing. We have written in saying (a) they do not give 30 days notice to a substantial change to our family members (b) we have no contract with the VA bought an HP (c) we have acted on the advice of staff of the VA - who now, not surprisingly, denies having said that we do not need to do something more.
Do we have a court case?
a. Does not look like a substantial change. Your son enjoyed the free membership because of their mistake and now they want boob 15h. Looks like you have won there.
bI think you do, when a company is taken over the title changes but not the contract. I'm sure the fine print will allow this.
C. Unlikely that you could prove it. The last time they made a mistake that you have purchased this time you lose.
I do not think it worth the cut and legal fees for a month charges
I am currently work type i I work in a gym in Ireland I am a consultant memebership .... All gyms have a record of all contratc you say you have lost your contract, it is not a problem as the gym will have a copy of it .... I advise no legal action as gyms always win, they have money to spend on court cases that if you mention you are takjen legal action so they can try to avoid the whole situation and to reach an agreement. also the fact that the gym was taken, they have the right to change prices, but not update the contracts I advise you to insist on seeing a copy of your contract and this should sort the problem out.also appropriate for them record on their system told why your child is free.
